By using the Chic Style Hire website at www.chicstylehire.com.au, you are accepting and consenting to the practices in these terms of use. Chic Style Hire reserves the right to change these terms and conditions from time to time at its sole discretion. Through our fashion hire service, Chic Style Hire aims to give you access to beautiful designer clothing.

 

Definitions

In these Terms and Conditions “you”, “your”, “customer” and “User” refers to all users of this website and “Chic Style Hire” (“we”, “our”, “CHS”, “service”) refers to Chic Style Hire (ABN 19 384 652 770).

The “Hire Period” refers to the User booking an item for a 4 day or 8 day period, starting from the day the garment is delivered to the User’s delivery address, to the day it is to be mailed back to Chic Style Hire.

 

Acceptance

These Terms of Use constitute a legally binding contract between you and Chic Style Hire. These Terms of Use apply to you whether you are browsing or are a customer of Chic Style Hire. 

The Terms of Use in force are published on this website, and by accessing and using the CSH website you will be taken to have accepted these terms of use. If you do not agree with the terms of use, do not access, use, submit information to or download from this website. These Terms of Use may change without notice, so do check from time to time. If you do not agree with any change, you should terminate the use of this website.

This agreement contains all of the terms and conditions regarding your hire of item(s) from Chic Style Hire via the website www.chicstylehire.com.au. You agree that hiring from CSH is subject to all our Terms and Conditions of use and Privacy Policy. These are available on our website and are subject to change from time to time.

You agree that you are hiring an item(s) and ownership of the product remains with Chic Style Hire at all times. Our items may be hired for customers who are under the age of 18 however we only hire directly to adults who may hire the products on behalf of a minor. By clicking “I accept” the hire agreement button you represent that you are over 18 years and are authorized to use the chosen method of payment with the purpose of hiring the item on the order. Where more than one User has entered into this agreement, the Users shall be jointly and severally liable for all payments. 

The User shall give Chic Style Hire no less than fourteen (14) days prior written notice of any proposed change in the User’s details (including but not limited to, changes in the User’s address, number or name). The User shall be liable for any loss incurred by Chic Style Hire as a result of the User’s failure to comply with this clause.

  

Our Commitment

We will deliver the garment that you have ordered including the correct size, colour, and style, on or before the date you have specified for delivery on your order. Except where we have indicated to you that your request for this is not possible or guaranteed and therefore your order has been amended. Items may appear slightly different in colour and style than the images listed on the website. Our liability to you for failure to deliver a product you have ordered is limited only to timely delivery.

 

Price and Payment Terms

An item’s “hire fee” will be the hire fee and delivery fees and any additional charges listed on the website in relation to your hired item. When you hire an item(s), you authorise Chic Style Hire to charge your payment method for your hire fee. We will charge your payment method immediately upon receiving your order.

In addition to your hire order for an item, you authorise Chic Style Hire to charge your payment method up to 200% of the entire original retail value of the product as set in the “retail price/RRP” on the website, only when you have not upheld your commitment to us as set forth in the hire agreement below. In the event an invoice is issued for payment for any reason, the payment shall be due within seven (7) days of the date of the invoice. All prices on our website are denoted in Australian Dollars.

At Chic Style Hire’s sole discretion, a deposit/bond may be required which shall be refunded upon return of the item in a condition acceptable to Chic Style Hire.

Payment may only be made by credit card or by any other method as agreed to between Chic Style Hire and the User. Full payment from the customer shall be due before delivery of clothing, your order will not be dispatched until full payment is received.

We may ask for photo ID, credit card details or other forms of identification. We can refuse the right to hire if you are unable to provide the requested identification or document(s). If we have requested this information, it is your responsibility to provide this information immediately. In the event we are unable to fulfil your hire or delivery on time due to the information not being provided, a credit note will only be applied, no refunds will be provided. 

Product Fit and Faulty Garment

If an item doesn't fit or, on the unlikely chance, the garment is faulty, the User must email CSH at info@chicstylehire.com.au within 4 hours of delivery indicating the issue. If the item is not the does not fit, we will try our best to send an alternative size or style (subject to availability) and courier service availability (must be within the Express network and dependent on a confirmation from Australia Post). If we are unable to send an alternative item for whatever reason, a credit note will be issued to the customer for the value of the hire less shipping costs.

You must inspect your dress, notify us and send photos of any damage/fault within 4 hours of garment delivery. You may be responsible for the damage if we are not notified within this time period and sent photo evidence of the damage. The User must return the unworn item(s) on the same day it was received. We highly recommend posting at a Post Office where the parcel is scanned. If the dress arrives back to us late and you are unable to provide postage proof within the 24 hours of delivery, then you will not be entitled to a credit note. A credit will only be issued if the item is unworn. The term “unworn” will be determined by Chic Style Hire and must be fulfilled prior to a credit note being issued.

Delivery

Chic Style Hire’s delivery method is Express postage, operated by Australia Post (see Australia Post's Terms and Conditions). Express postage is a guaranteed next business day delivery within the Express Post network only. If the User’s location is outside of the Express Post network, it will take more than one business day and CSH has no control over this. The delivery rate is $19.99, this fee includes the delivery to you, and the return back to us (using the pre-paid label provided in the satchel). Please note this rate only covers items sent in the same order. If you are booking more than one dress and they are for different dates, you must place your bookings separately and pay the shipping amount separately in each order. Any delivery time or date given by CSH to the User is an estimate only. The User must accept delivery, even if early or late, and CSH will not be liable for any loss or damage incurred by the User as a result of the delivery being early or late. We aim to deliver hires as early as possible to minimise any postage delays. Your delivery may occur up to seven (7) days prior to your chosen delivery date. Please ensure you provide a permanent address where there will be somewhere safe to leave a parcel or someone to accept the parcel up to 7 days prior to your chosen delivery date. 

When placing an order, you give us authority to leave your parcel in a safe place. You understand and agree that this authority to leave gives us and/or AusPost permission to leave the satchel unattended by the front door, in the letterbox, at the reception desk or where applicable, at the delivery address without obtaining a signature confirming delivery. We and our courier are released of all responsibility and liability for the satchel when delivered, and that responsibility and liability transfers to you on delivery. 

We do not take responsibility for orders where an incorrect/ineligible address has been provided. If you have supplied an incorrect address you will not be entitled to a refund of any kind and you may be liable to pay any late fees or a replacement fee if the dress is not returned to us. In the instance where a parcel is unable to be delivered in time due to Australia Post being unable to gain access and/or leave the parcel in a safe place, you will not be entitled to a refund of any kind and you may be liable to pay any late fees or a replacement fee if the dress is not returned to us on time. If you have supplied an address that has a redirection service set up and your parcel is not delivered in time you will not be entitled to a refund. Once the parcel has been dispatched if you redirect it in any way you will not be entitled to a refund if it does not arrive by the chosen delivery date. Redirecting a parcel will increase the delivery time by approximately 2-5 business days.

On the rare occasion that the dress is delivered after your return date, you are still required to return the dress as soon as possible (no later than 24 hours after delivery). If you require additional time to return the dress due to a late delivery, please email info@chicstylehire.com.au. If an item is not returned you are liable for 200% of the item(s) retail value. You may also be liable for late fees if you do not return the garment within a reasonable timeframe. It is therefore required that you select a permanent address where someone will be available in the unlikelihood of the dress not being delivered as per your chosen date.

Please note we aim to deliver every item as quickly as possible. If you order in advance and the dress does not arrive to you in time, you will be entitled to a full refund. Any last-minute hires (orders placed less than one week before being despatched) that do not arrive in time will be entitled to a credit note only and not a refund.

 

Hire Period and Late Fees

The hire period shall commence from when the parcel has been left in a safe place at the User’s nominated delivery address and shall continue until the item(s) is dropped off at the Post Office on the return due date.

Where item(s) have not been returned to CSH by the end of the User’s Hire Period, CSH is entitled to charge additional Hire Fees until the item(s) is returned. The User expressly authorises CSH to deduct such additional Hire Fees from the User’s payment method which was provided at the time of placing of the User’s order. Such additional charges shall be charged at a fixed rate of 50% of the Hire Fee for each day overdue. When counting overdue days CSH shall not count Sundays or Public Holidays when the Post Office is closed. If the User pays CSH an amount equal to 200% of the retail price in late fees and the User still has the item(s) in their possession, the item(s) is the User’s to keep. If the User has not returned the hire item(s) within 15 days after the return date, CSH will consider the hire item(s) as non-returned and will charge the User’s payment method the 200% of the hired item's retail value, less the hire and late fees that the User has already paid.

 

Returns

Item(s) must be posted on the last day (fourth or eighth day) of the hire period in the same postage bag from CSH by sticking the new return label directly over the delivery label and personally resealing the satchel. We highly recommend posting at a Post Office where the parcel is scanned. If the dress arrives back to us late and you are unable to provide proof it was posted within the 24 hours of your return date, then you may be subject to late return fees until the garment is received by CSH.

 

Cancellation Policy
Hire fees are non-refundable. If you cancel your hire and give us 7 days’ notice, then we will happily issue you a credit note to be used within 6 months from the date of cancellation; no cancellation fees apply. Once the item(s) has been dispatched from Chic Style Hire, your request for a hire cancellation will not be accepted.

CSH reserves the right to cancel a booking on short notice. Reasons for cancellation may include (but are not limited to) an item not being available due to late return by a previous customer or damage to the garment. In the event of a cancellation by CSH, we offer a full refund, store credit or the option to change the booking to another item.

 

User:

By accepting these Terms and Conditions, I authorise Chic Style Hire to charge the provided payment card according to the terms outlined above. This payment authorisation is for the goods/services described above, for the amount indicated above only. I certify that I am the authorised user of this payment card and that I will not dispute the payment with my credit card company, so long as the transaction corresponds to the terms indicated on this page.

If Chic Style Hire does not receive payment from your credit card provider or if your credit card expires or is rejected, you agree to pay all amounts due upon demand. If any monies payable remain unpaid by you after 7 days from the date of demand, you authorise Chic Style Hire to charge any outstanding fees and other amounts due to us in accordance with these Terms and Conditions against any payment card you have on file with us. Chic Style Hire reserves the right to take all steps necessary to collect amounts due from you, including but not limited to legal action and/or using third party collection agencies.

By hiring with Chic Style Hire, you agree to take care of the garment, and not alter the garment in any way. If the hired item was to be accidentally damaged, such as (but not limited to a spill, a tear or a pull), you agree to immediately notify Chic Style Hire of the damage with photo evidence emailed to info@chicstylehire.com.au. You must also not attempt to fix, wash, or clean the item yourself as Chic Style Hire has a professional team that are familiar with each item’s fabric and care instructions. Chic Style Hire will cover the cost of the damaged garment repairs up to $20, if expenses exceed this threshold, the User will be notified as they are liable to pay the excess amount due. In the rare circumstance that an item is damage beyond repair, or the user makes personal alterations, the User will be notified and charged the retail value of the item as the garment will be sent to the User and will no longer be owned by CSH.
